Acceptance of Terms
By accessing or using the Agility Evolved, LLC ("we," "us," or "our") website at agilityevolved.com (the "Site") and its courses, materials, and services (collectively, the "Services"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, please do not use the Services.
Modifications
We reserve the right to modify these Terms at any time. When we do, we'll update the "Effective Date" above. Continued use of the Services after changes constitutes your acceptance of the revised Terms.
Eligibility
You must be at least 18 years old to enroll in our courses. By registering, you represent and warrant that you meet this requirement.
Account & Security
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.
License & Restrictions
Limited License: Upon full payment, we grant you a non-exclusive, non-transferable, revocable license to access and view the course content for your personal, non-commercial use. No Redistribution: You may not copy, reproduce, distribute, publicly perform, publicly display, publish, license, create derivative works from, transfer, or sell any course materials, whether in whole or in part. Recording, screenshotting, or otherwise capturing the content is strictly prohibited.
Payments & No Refunds
All fees are quoted in U.S. dollars and must be paid in full prior to course access. No Refunds: We do not offer refunds. In emergency situations, we will make reasonable efforts to reschedule you into another upcoming class of equivalent value.
User Conduct
You agree not to engage in any activity that infringes any third-party rights, disrupts or impairs the Site's operation, or violates applicable laws or these Terms. Code of Conduct & Ejection: We expect all participants to treat instructors and fellow students with respect. We reserve the right to eject from any live or in-person class any attendee whose behavior is rude, disrespectful, harassing, or disparaging toward others. Such ejection may occur at our sole discretion, and the ejected participant will not be entitled to any refund or rescheduling beyond what's provided in Section 6.
Intellectual Property
All content, trademarks, service marks, and logos displayed on the Site are our property or the property of our licensors. Nothing in these Terms grants you any rights to use our intellectual property without our prior written consent.
Disclaimers & Warranties
Our courses are designed to prepare you for professional certifications and practical application in your work. To the fullest extent permitted by law, we disclaim all other warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the maximum extent permitted by law, in no event will Agility Evolved, LLC, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services.
Indemnification
You agree to indemnify, defend, and hold harmless Agility Evolved, LLC and its affiliates from any claims, losses, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Services.
Dispute Resolution & Governing Law
Any dispute arising out of or relating to these Terms or your use of the Services will be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will be conducted in Allen, Texas, and Texas law will govern these Terms, without regard to conflict-of-law principles.
Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.
